General conditions and Privacy policy

GENERAL CONDITIONS WIDEM LOGISTICS        

 

Article 1 :   These general conditions are supplemented by special conditions in which the methods of WIDEM Logistics are further explained.  

Thus all the transactions of WIDEM Logistics are controlled by the CMR treaty in its capacity as (agent) transporter.

controlled by the “General Logistical Conditions” and the “General Conditions for the Handling of goods and the related Activities at Antwerp harbour” in its capacity as handler of goods.

controlled by the “General Belgian Freight Forwarding Conditions” in its assignments with respect to customs, BTW [Belgian VAT] and taxation administration.  

These special conditions are sent to each new contractor of WIDEM Logistics in reply to the sending of the first definitive offer and these special conditions remain applicable during the further commercial relationship between the parties.   When a stipulation of the above mentioned special conditions is irreconcilable or would be in contradiction with these general conditions, the stipulations of the present general conditions will apply.    

 

Article 2 :   The parties agree that the sender and the addressee always guarantee the loading, stowing and respectively the unloading of the goods. Even if the driver of WIDEM Logistics or his subcontractor is present at the loading and even helpful with the loading, stowing or unloading, he still handles under the authority, management and supervision of the sender or the addressee.  

 

Article 3 :   There is an explicit agreement between WIDEM Logistics on the one hand and its client on the other hand, that all services – those relevant to the transport as well as those relevant to the handling of the goods – form a whole and that all goods that are or will be entrusted to WIDEM Logistics by the client serve as bond for the payment of the claims from WIDEM Logistics.                   

 

Article 4 :   The invoices are payable in Rekkem no later than the expiry date listed on the invoice, without discount and without the possibility for setting off debts. In the event of non payment on the indicated expiry date, by law and without prior notice of default a late payment interest will apply to all unpaid amounts, equal to an interest at the reference interest rate plus seven percentage points and rounded off to the higher half of a percentage point, as well as – and this notwithstanding the court costs – a fixed compensation of 10 percent on the outstanding amount, with a minimum of 125 EUR and a maximum of 2,500 EUR.  

 

Article 5:   All transactions of WIDEM Logistics are subject to the stipulations of the Belgian Law, unless explicitly otherwise agreed. All disputes regarding the interpretation and implementation of this agreement fall under the authority of the Courts of Kortrijk. In the event of a challenge regarding the interpretation of the current general contract conditions, the Dutch language version will be decisive.

Personal data processed by Widem Logistics    

 

Personal data consists of all information about personal or factual characteristics that can identify a natural person. Examples include a name, address, telephone number and date of birth.

Widem Logistics processes your personal data for the purpose of carrying out our transport and/or logistics services or because you provide them to us yourself.

In most cases, we receive personal data in order to provide transport or logistics services for a client. When you make use of our services, we will treat your personal data with care and only use it for the purpose for which it was collected. Below you will find an overview of the personal data that Widem Logistics may process in order to perform its services:

Shipping information (such as shipment related information regarding; name, physical address, e-mail address and telephone number, receipts, and shipment number).

Information of individuals and business contacts (such as name, company name, physical address, e-mail address, telephone number or fax number).

Account data (including IP address) to access parts of the Widem Logistics website.

Name, company name, telephone number, email address when contacting via the contact form.

Data for consignments where authorities of the country of transit or destination are granted customs and tax and security controls. This is required by the legislation in the country and includes: (Name and address of consignor and consignee, description of goods, number, weight and value of the consignment).   

 

Purposes for which Widem Logistics processes personal data    

 

Widem Logistics collects and processes personal data, mainly obtained from clients, for the purpose of providing logistics and transport services and optimising its business operations. The personal data is used for transport and logistics services such as:

The collection, delivery and tracking of shipments

Providing products and services that are carried out at the request of customers (such as logistics services, supply chain management, multimodal transport and customs clearance)

Providing customer service and responding to and communicating with you about your requests, questions and comments.

Creating and managing your Widem Logistics account

Processing and collecting payments

Processing claims related to our services

Conducting, evaluating and improving our operations (including developing new products and services; communicating; improving the effectiveness of our sales, marketing and advertising; analyzing and improving our products, services and websites; and performing accounting, auditing and billing).

Marketing and customer contact maintenance.

Evaluating and improving our activities (including developing new services, managing communications, measuring effectiveness, ensuring the security of our information systems and networks, accounting, auditing, invoicing). Protect against, identify and prevent fraud and other criminal activities, claims and other liabilities

Comply with current laws and regulations and our policy    

 

 No automated decision-making  

 

Widem Logistics does not make decisions on the basis of automated processing on matters that could have (significant) consequences for individuals. These are decisions that are made by computer programs or systems, without any human being in between.  

 

How long Widem Logistics retains personal data  

 

Widem Logistics does not retain your personal data longer than is necessary to achieve the purposes for which your data are collected and/or necessary to comply with applicable laws and regulations. These purposes are the performance of transport and logistics services and the execution of agreements made with our clients. When data is no longer necessary for the stated purposes, it will be deleted, unless legal or practical obstacles prevent this. If this is the case, the data will be blocked.   

 

Sharing personal data with third parties by Widem Logistics 

 

 Widem Logistics does not sell or otherwise share personal information about you except as described in this privacy statement. Widem Logistics will share your personal information with various third parties if this is necessary for the performance of the agreement and to comply with any legal obligation. These include carriers, logistics service providers and support services relating to ICT services. In order to perform our logistics and transport services, Widem Logistics shares shipping information with third parties such as; carriers, consignees and third parties who provide services at our request and our instructions. These parties are not authorized by us to use or disclose the information except as necessary to provide services on our behalf or to comply with legal requirements. Your personal data will not be shared outside the European Union (EU), European Economic Area (EEA) or countries approved by the European Commission (EC).    

 

Right to access, modify or delete data     

 

Widem Logistics guarantees in all reasonableness the rights of data subjects who entrust Widem Logistics with their personal data, obtained for the performance of transport and/or logistics services. You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your possible consent to the data processing or to object to the processing of your personal data by Widem Logistics and you have the right to data transfer. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or another organisation you have mentioned. You can submit a request for inspection, correction, deletion, data treatying of your personal data or a request to withdraw your consent or objection to the processing of your personal data on this page under the 'NEEM CONTACT UP' button. How Widem Logistics secures personal data   

 

Widem Logistics takes the protection of your data seriously and takes appropriate technical and organisational measures to protect against loss, misuse or unauthorised access. For example, your data is stored in a safe working environment and is not accessible to unauthorised persons. In addition, our web services are equipped with SSL technology and are therefore transmitted in encrypted form.
